Privacy & Network Security Liability

Defense and indemnity for covered claims alleging:

  • Loss of or failure to protect Personally Identifiable Information , Protected Health Information or Confidential Business Information (includes drawings, designs, customer requirements, specifications, financial information, trade secrets, customer lists, and marketing plans)
  • Violation of any law, statute or regulation governing the protection of personally identifiable information or protected health information
  • Violation of a federal, state or local data breach reporting requirement
  • Includes coverage for the wrongful acts of rogue employees who compromise protected information without the knowledge of the firm
  • Failure to prevent a cyber-security breach that results in:
    • the inability of an authorized user to gain access to the network
    • the malicious addition, alteration, copy, destruction, deletion, disclosure, damage, removal or theft of data residing on the network
    • a denial of service attack emanating from the network which damages or destroys a third party’s hardware, computer programs or electronic data residing on a third party’s network
    • the transmission of malware from the network to third parties
